Debate on the right to stay in Austria

Arigona

In the aftermath of the case of 15-year-old Arigona Zogoy, who was hiding from the authorities after her father and siblings were deported to Kosovo late last month, a number of similar cases surfacing in the media have created an alarming picture of deportation practices in Austria.

One of the main problems seems to be, that the - already extremely rigid - asylum trials take several years to be finished. According to refugee organizations, it’s quite usual that applicants have to wait for more than six years before a final judgement has been given. A handful of families, all of the living in Austria for several years now, have submerged in the past week due to acute threats of being deported.

In one case, a 6-months old baby is threatened to be deported - without her mother, whose asylum-trial is still running. In one of the official letters the 21-year-old woman from Nigeria had received earlier this year, the authorities state that “submerging” in the former capital of Nigeria shouldn’t be a problem for her, before listing jobs, where young women were exceptionally successful because they can easily attract male costumers - like sex-workers for example.

In another case, an 18-year-old man - who came to Austria unattended as underage refugee - rammed a knife in his chest on the main square of Steyr, a small town in upper Austria. Before, he had distributed leaflets describing his situation after having received a negative judgement on his asylum-trial.

The sheer number of similar cases having emerged only in the weeks after Arigona Zogoy draw media’s attention to the issue, suggest that the migration law and it’s execution systematically produces cases like those described above. And the question rises, why most of those cases had not been covered earlier - despite numerous reports of NGOs. In fact, the question can easily be answered considering the predominantly right-wing orientation of a large part of Austria’s media-landscape.

There had been many protests in favor of the right to stay in the past months as well: on October 6, around 500 people were protesting in favor of Arigona Zogaj and her family in Frankenburg, Lower Austria; on October 9, up to 7.000 protesters had followed a call by the Green Party, demanding the right to stay for immigrants; on October 16, school-kids went on the streets in Vienna, Linz and Dornbirn; on October 20, people went on the street in Steyr in order to show their solidarity with Dennis, who had attempted suicide ten days before; and on October 25 people were gathering in Vienna in order to confront the migration policies of the government coalition.

The answer of authorities and right-wing politicians is quite clear. The conservative governor of Lower Austria, Erwin Pröll, had stated already a few weeks ago, that minarets would be “artfremd” - “foreign to the species”, a term invented and used by the Nazis - didn’t hesitate to support the minister for interior, Günther Platter, on his view that the deportation were legitimate. The chief of the Green Party in Lower Austria, Marlene Petrovic, has been denounced for presumable helping “illegal” immigrants and is facing a penalty of up to 6 months in case of being convicted. For 2008 regional elections are scheduled and the right wing parties - the two extreme right parties FPÖ and BZÖ as well as the conservative ÖVP - are fighting over votes in the far right spectrum.

In Carinthia’s capital Klagenfurt, police raided the house of a woman, who has been giving language classes to refugees without charging them for three years now - “the officers had turned the whole house upside down”, Christa J. told to the newspaper Der Standard, obviously without having a valid search warrant.

International Conference “Violations of Human Rights at Borders
October 6, 2007

We,
members of solidarity organizations, national and international networks, grass roots organizations based in countries of the global South and the global North, who work towards the enforcement of basic rights for migrants, asylum seekers and refugees and a just development policy, gathered in the city of Oujda on October 6, 2007, to hold a conference on violations of human rights at borders, thereby following the Euro-African Manifesto’s guidelines.

We pay our respect to all people who died while migrating, especially to those who lost their lives in fall 2005 in Ceuta and Melilla.

We denounce the inhuman conditions, in which migrants have to live: continuously haunted and deported from one side of the border to the other by Moroccan and Algerian forces, eventually proscribed to the peripheral area of Oujda.

We criticize current politics that aim to relocate the ratification of the right of asylum solely to non-European countries and to transfer the exercise of repression, all in the name of ?migration management?, thus bearing the responsibility for numerous deaths and extensive suffering.

We reject the criminalization of migrants and the repression to which they are subjected at country and maritime borders.

We condemn the harassment and pressure, with which activists and advocates of human rights are confronted on a daily basis.

We bring to mind our support for the Manifesto of Rabat of July 1, 2006, adopted during the Euro-African Non-Governmental Conference ?Migrations, Basic Rights, Freedom of Movement? and demand:

- A thorough investigation of the crimes that have been committed in the nights of September 28/29, 2005 in Ceuta and October 5/6, 2005 in Melilla.

- That the liability of the Moroccan and the Spanish governments for these crimes be recorded.

- That the people in charge and involved persons be held to account.

- That all involved governments respect the basic human rights and international obligations for every person as laid out in the Declaration of Human Rights and all other international conventions and treaties, especially with regard to the treatment of individuals at borders ? ashore, at sea and in airports.

- To stop all economical and political pressure by the EU and its member states against countries of origin or transit, as they result from the European Partnership Agreement (EPA) and other agreements, which make these countries the agents of border control, migration management, screening of migrants and their deportation.

BB discovered this video by Jasmin Jodry aka Sophisicated Madness, it’s called Time Patrol and it features an unreleased tune by Kode 9. After Audio Addiction - the official title for the video of 9-Samurai - it’s her second work with Kode 9 & The Spaceape.

A slightly different approach is taken by Kristy Brown in her video Lunch with the PM, combining images of the anti-war-movement with the sound of Sydney-based dubsteppers Westernsynthetics.

Besides classic music-clips, two documentaries on dubstep were circulating in 2007: Eyes Down, which was already mentioned here earlier, and Ikonika’s It’s Not Just Bass. Ikonika, a London based producer and filmmaker, interviews a wide range of dubstep activists in her video, giving a quite good overview of the scene’s momentum. The video also features her own tunes such as the fabulous Phonelines.

Saturday, 6pm: Mat calls me from Budapest, telling me that N-Type has missed his flight because his car had been towed away in Birmingham, asking if Jay-S & myself wanted to come and fill in. Two hours later I’m sitting in a train to Budapest… an enthusiastic, remarkably open-minded crowd awaits us in a packed venue, soundsystem is fine too… just perfect ingredients for a heavy night out! At 6am we’re back on the train back to Vienna, where we arrive at 9:30, just in time to have a coffee before heading directly to work… ;)
